Hardware Terms
OVERVIEW
This website is operated by EarthOne. Throughout the site, the terms “we”, “us” and “our” refer to EarthOne. Welcome to our Hardware Plan ("Plan"). By participating in the Plan, you agree to be bound by these Terms of Service ("Terms"), which constitute a binding legal agreement between you, the user, and us, regarding your participation in the Plan. Please read these Terms carefully.
The Plan allows eligible customers to purchase hardware devices ("Device") from us and pay for them over time, under the payment terms outlined herein. The Plan is not a credit facility, loan, or credit sale.
SECTION 1 - ELIGIBILTY
To be eligible for the Plan, you must:
Be at least 18 years old or of legal age in your jurisdiction.
Have a valid and verifiable email address and payment method.
Agree to these Terms.
SECTION 2 - PAYMENT
Upon agreeing to purchase a Device under the Plan, you commit to a payment plan consisting of monthly payments as specified at the time of purchase ("Monthly Payments"). The total amount payable will be equal or lesser than the retail price of the Device, plus applicable taxes and fees, divided over the term of the Plan ("Term").
You may choose to pay off the remaining balance of your Device at any time ("Payoff"). The Payoff amount can be a minimum amount that must be paid to cancel monthly payments and disable your Device, known as "the Tab" or the remaining Term amount to keep the devices functional. Information on how to Payoff your Device, including the Tab, will be provided in your Plan account.
SECTION 3 - MEMBERSHIP
Membership features included in the Plan, such as access to premium services, discounts, and exclusive content ("Member Features"), are subject to change. We reserve the right to modify, add, or remove any Member Features at our discretion without prior notice. Changes to Member Features will not affect the Monthly Payments or the overall cost of the Plan but may alter the benefits available to you.
SECTION 4 - TERM & CANCELLATION
The Term of your Plan will be specified at the time of purchase. You may not cancel the Plan until you have fully paid off your Device. If you wish to cancel the Plan before the end of a 6-month period, you may be subject to an early cancellation fee ("Early Cancellation Fee").
Cancellation before fulfilling the Term requires the Payoff of your Device, including any outstanding Monthly Payments, Early Cancellation Fee, taxes, and fees.
Upon cancellation, all Member Features associated with your Plan will be removed from your account. Should you wish to continue enjoying any Member Features, these will need to be repurchased either through a new Hardware Plan or as part of our separately offered standalone membership.
SECTION 5 - BILLING ISSUES
Failure to make a Monthly Payment by the due date will result in the suspension of services associated with your Device as well as Member Features. In the event of a missed payment or billing issue, Device functionality may cease until the issue is rectified.
We reserve the right to take necessary collection actions for missed payments, including but not limited to, legal action and reporting to credit reporting agencies.
SECTION 6 - GOVERNING LAW
These Terms shall be governed by and construed in accordance with the laws of Canada, without regard to its conflict of laws principles.
SECTION 7 - CHANGES TO TERMS OF SERVICE
We reserve the right, at its discretion, to modify these Terms at any time. You will be notified of any changes to the Terms, and continued participation in the Plan following such modifications constitutes your acceptance of the changes.

ACKNOWLEDGMENT
By purchasing a Device under the Plan, I acknowledge that I have read, understood, and agreed to be bound by these Terms of Service, including the obligations regarding Term and Cancellation, as well as the consequences of Missed Payments and Billing Issues.
